1. Parties to the Agreement
These Terms of Service define the rules of cooperation between Lokean Artshop (hereinafter referred to as the Artist) and the Client, the person commissioning the creation of a digital illustration or other artwork.
Placing an order constitutes acceptance of these terms.2. Scope of Services
2.1. The Artist creates digital illustrations based on individual arrangements with the Client (hereinafter: the “Commission”).
2.2. Each commission is priced individually depending on the complexity of the project, number of characters, type of background, and other elements.
2.3. Base prices refer to one character with a simple or no background.
2.4. The Artist reserves the right to refuse any commission for any reason, without providing an explanation, before the deposit has been paid.3. Additional Options and Fees
3.1. Second and each additional character in the same illustration: +70% of the base price.
3.2. NSFW content: +30–100% of the base price, depending on the level of explicitness and pose.
3.3. Backgrounds:
- Simple backgrounds (gradient, solid color, basic shapes) – included in the price.
- Complex backgrounds (locations, interiors, landscapes) – individually priced.4. Original Character Design
4.1. For commissions requiring the creation of an original character, creature, item, outfit, or other element based only on the Client’s description, inspirations, or general guidelines (without an existing design or complete references), an additional fee of +20–50% of the base price applies.
This surcharge reflects the extra time and creative effort required to develop the full visual concept (e.g. clothing, accessories, appearance details, color palette, proportions, etc.).
4.2. This fee does not apply if the Client provides full references of an existing character to be depicted, or if the artwork is a fanart of a culturally known character.5. Payment Terms
5.1. A non-refundable deposit of 50% of the total price is required before work begins.
5.2. The deposit becomes non-refundable once work has started (e.g. after the sketch, composition, or references have been sent).
5.3. If the Artist cancels the commission for any reason, the deposit will be refunded in full, regardless of progress.
5.4. The remaining 50% is due after the Client approves the final artwork.
5.5. Payments are accepted in PLN or foreign currencies via PayPal. For foreign payments, a 2.5% currency conversion fee applies.6. File Delivery
6.1. Finished artworks are delivered digitally via a private Google Drive folder dedicated to the Client.
6.2. Default file format: PNG (high resolution, transparent background).
Other formats are available upon request, if agreed before the work begins and the Artist confirms feasibility.
6.3. The Artist can provide physical prints upon request — this can be arranged at any stage before final approval.
The Client will cover printing and shipping costs.
6.4. The Artist is not responsible for print damage that does not result from improper packaging.7. Completion Time
7.1. The estimated completion time depends on the project’s complexity, current queue, and the Client’s responsiveness.
7.2. For queue positions 1–5, completion typically takes up to one month.
7.3. The Artist will inform the Client of any delays and provide the current queue status at the time of ordering.
7.4. The Artist will notify the Client of the exact start date of the commission.8. Revisions
8.1. Two rounds of revisions during the sketch stage are included in the price (e.g. composition, pose, outfit).
8.2. Major or additional changes (e.g. concept, pose, or costume redesign) may incur extra fees, depending on scope.
8.3. Minor adjustments that can be made within a few minutes may be free of charge, at the Artist’s discretion.
8.4. Revisions requested after the final artwork is approved are treated as a new commission.9. Copyright and Usage
9.1. All moral and economic copyrights remain with the Artist unless explicitly transferred in a written agreement.
If ownership rights are not transferred, the Client may not earn profit from the commissioned artwork.
9.2. The Client receives a personal, non-commercial license (e.g. avatar, wallpaper, or social media post, with proper credit to the Artist).
9.3. Commercial use (e.g. printing, merchandising, games, books, NFTs, etc.) requires written permission, a separate license agreement, and additional compensation.
9.4. The Client is strictly prohibited from making any modifications to the artwork, including:
- color or lighting adjustments,
- adding backgrounds or graphical elements,
- retouching, cropping, or editing,
- removing or altering the Artist’s signature.
9.5. The Client may not resell, redistribute, or alter the artwork, including in cases where the Client sells their own character featured in the piece.
9.6. When posting the commissioned artwork on social media or any online platform, the Client must credit and tag the Artist’s account (if such account exists on the platform used), unless otherwise agreed in writing.10. Publication and Confidentiality
10.1. The Artist reserves the right to publish both finished and unfinished works (including WIPs – work in progress) in their portfolio, on social media, or in promotional materials.
10.2. If the Client, before work begins, informs the Artist that the commission should remain confidential (e.g. a gift or surprise), the Artist may agree to withhold publication until a mutually agreed date.11. Liability
11.1. The Artist is not responsible for data loss after the final files are delivered or for any issues resulting from the Client’s improper use of the files.
11.2. In case of hardware failure, illness, or other unforeseen circumstances preventing completion, the Artist will refund the deposit or, by mutual agreement, extend the deadline.12. Communication
12.1. All communication regarding the project (references, revisions, confirmations, and payments) takes place electronically.
12.2. Lack of response from the Client for more than 14 days may result in the suspension of the project.13. Final Provisions
13.1. Placing an order constitutes acceptance of these Terms and forms a contract for a commissioned artwork.
13.2. The Artist may update these Terms; the version valid at the time of ordering applies to both parties for the duration of the commission.
